Priorities — Protection and Civil Rights

Fiscal Year 2008 Through 2010 (October 1, 2007 through September 30, 2010)

SUBJECT AREA 1
Abuse & Neglect

Our vision is that individuals with disabilities are not abused or neglected.

  1. There are effective systems in place to prevent and investigate caregiver or service provider abuse, neglect, exploitation, in the community or in facilities, including cases of
domestic violence, against persons with disabilities.

SUBJECT AREA 2
Restraint & Seclusion

Our vision is that individuals with disabilities are not restrained or secluded illegally.

  1. Restraint and seclusion are used only in compliance with regulations or best practices.

SUBJECT AREA 3
Civil Rights

Our vision is that individuals with disabilities have the full range of rights guaranteed to everyone.

  1. Individuals with disabilities are involved, in a meaningful way, in determining their own treatment and each person's informed consent is obtained before treatment.
  2. Persons with disabilities are able to exercise their civil rights and service providers respect the civil rights of persons with disabilities.
  3. The rights of individuals, both children and adults, who come in contact with the criminal justice and/or juvenile justice system, are respected.
  4. Admissions to state schools are reduced or eliminated, consistent with the Americans with Disabilities Act, the Supreme Court Olmstead decision and access to services in the most integrated setting.
  5. Individuals with intellectual disabilities (formerly known as mental retardation) have appropriate and adequate protections and due process in commitment hearings.
  6. Persons with disabilities are not unnecessarily placed under guardianship.
  7. Individuals seeking or receiving independent living services, unrelated to an employment goal, are able to effectively resolve grievances with their independent living center.
